Is it possible to take somebody out of a lease?

My roommate and I added somebody on the lease 4 months ago and it is not working out. She has no respect for other people’s space, never clean up after herself in the common areas. Plus she broke a couple of things and never even apologized or offer to replace them. We all agreed (including her) that it was not working out and she contacted the realty company to get off the lease early even though it was only an oral agreement we searched and found somebody to replace her and now she decided it was ok for her to stay. Is there anything we can do?

No. Unless she leaves voluntarily you are stuck until the end of the lease.

What knowledge does a Realtor need for a Short Sale?

I’ve been reading up on Short Sales (because I’m almost positive that my house won’t sell for what is owed), and many people have given advice that you should have a Realtor who is familiar with Short Sales. My husband & I signed with a Realtor that isn’t familiar with Short Sales before fully realizing that it’s the only way we’ll get out of our Mortgage. What should my Realtor know that’s different than a regular sale? She’s been in the business for many years, so common realty knowledge isn’t a problem.
Someone answered another question saying that a normal contract shouldn’t be used. What’s up with that?
Should our house be listed as "possible short sale"?

Your Realtor can educate him/herself. You need to give her permission to talk to your lender and inform the lender that your realtor is allowed to talk to them as well.

She has to disclose on the listing that it is a short sale and that acceptance is contingent to lender’s approval.

You have to get the "short sale" package from the lender, fill it out and get it back to your lender. Give a copy to your Realtor.

Ask your Realtor to stay in contact with the lender, check if current appraisal was done, inspections, find out if there are other liens on the property.

If you get an offer on the property make sure that all paperwork rquired by the lender is attached to it including a pre approval letter or a proof of funds from the buyer and in most cases a estimated closing statement .

Ask your Realtor to talk to the lender, get a contact name and phone number. In most cases they have people at the lender who will guide you (your Realtor) throu.

Communication is very important for a successful closing of a short sale.

Is anyone else sick of seeing beautiful people on TV and in the movies?

I’m sick of it. Just sick, you hear? Newscasters, talk show hosts, realty TV stars, video jockies, movie stars, rock stars – there isn’t a single soul in visual media today that isn’t piled with make-up in an attempt to make them look deceptively gorgeous. I’m not saying I want to see all their zits and wrinkles, but haven’t we gone too far? Why can’t there be any normal people in movies?

Oh my stars I thought I was the only one thinking that. yep, since we’re all different and the big claim to accpet the different ethnic groups and diversity then we should be seeing normal people, everyday people.

How should I advertise my my construction company?

I own a construction/remodeling company in Eastern Massachusetts. I am looking for ways to advertise my company at a low cost. Ive tried craigslist and theres just too many ads up there. Need a way to set myself from the rest. I am going to put an ad in the paper next weeks, what are some other ideas? I was thinking of emailing realty companies? good/bad idea? who should I give business cards or emails to?

1) Be involved with local chambers of commerce
2) Participate in group-mailings with other nearby merchants involved in different lines of business.
3) Put ads in a local newspaper week after week for atleast several months.
4) Put your name and telephone number on your own vehicle(s).
5) Place a sign in the yard of each homeowner you are working for right now.

Who is liable for the fees incurred by me according to the law in Chicago?

On 5/26/2007, I mailed my monthly rent check to my landlord for rent due on 6/1/2007. On 6/5/2007 I received a five day notice from the company stating that they’d never received my rent check. I was then instructed that I had to obtain a cashier’s check, or that they would start eviction proceedings, which costs $7, and was assessed late fees in the amount of $19.40, because, again, they said they’d never received my check. On 8/10/2007, the original check I sent them was cashed, sending my account into a negative dollar amount, which caused $75 in insufficient funds fees to be assessed to my checking account. I contacted Bonheur Realty regarding this, asking for some sort of compensation, because obviously this was an error on their part. There is no other avenue set up for us to send our rent checks, and if the post office loses them, or the bank makes an error, it is not right that the tenants have to bear the burden of these mistakes. Am I due back all the fees I’ve incurred?

No, you are not due any fees back. You should have placed a stop payment on the original check, that way the Realty Company would not have been able to cash it.

A better way to handle this going forward is to sign up for an online banking with bill payment option that offers protection from problems like this (National City Bank has such a program), the only catch is you have to put through the payment online by a certain date in advance in order for the check to arrive on time.

If the check does get lost in the mail, all you have to do is then contact the bank, who will contact your landlord and provide proof that payment was sent and on what date and they work out out the late payment or any other penalties with the place the check was issued to and you don’t have to pay for a stop payment on the check.

How can i calculate for damages if i want to press a civil suit to be incorporated to an existing estafa case?

We filed estafa through falsicifation of public document against those people who gave us fake realty titles for mortgage. The case is in court but it seems to me that the culprits are using delaying tactics in avoiding to pay us the amount they stole. They will not make a definite offer to their settlement. They keep changing their statements in front of the judge. Please help because i want to know if i can get justice by pressuring them to pay up. How can i calculate the damages i can demand if this thing pushes through. My lawyer friends please help by giving out your contact details so that i can explain futher. Help me. I am paraplegic (in a wheelchair) with no connections. They already got my money but if my lawyer would tirelessly pursue this i would gladly make a deal to share a portion of whatever i can get out of the settlement. My email is del_dioquino@yahoo.com. Judging from what you wrote, you already have an attorney and it is already a court case. You cant hurry this along. Its in their hands now. So just be patient and let them handle it. It is NOT a fast process. And yes, the culprits attorney is probably delaying it, hoping that you will give up and go away. Dont do it. Just hang in there. No one can help you on this one except your lawyer.
